Trademark & Copyright Guide for Custom Products
At SEVA Cornhole, we’re proud to offer custom boards and bags made in the USA — but we can’t print trademarked or copyrighted designs. This guide explains the difference between trademarks and copyrights, why even AI-generated versions of sports teams or superheroes can still be an infringement, and how to create custom cornhole gear that’s truly yours.
What’s the Difference Between Trademarks and Copyrights?
- Trademarks protect brand identifiers like names, logos, slogans, and mascots.
- Copyrights protect creative works like movies, songs, books, and artwork.
Both are forms of intellectual property, and using them without permission is considered infringement.
Why We Can’t Use Them
We are legally not allowed to reproduce or alter trademarked or copyrighted images on custom products. Doing so would be considered infringement, even if the item is just for personal use.
What About AI-Generated Images?
AI may “create” an image, but if it depicts or resembles a trademarked or copyrighted property, it’s still an infringement. Examples:
- An AI-generated picture of a pro team jersey is still that team’s protected brand.
- An AI-drawn version of Spider-Man is still a Marvel character, and Marvel owns those rights.
- Even “stylized” or altered AI images of famous logos or characters are considered derivative works and fall under the same protections.
